Specifically, the Plaintiffs sought to have the Court: (a) declare the amendments illegal, null and void; (b) prohibit the Plan's Administrator from administering the Plan contrary to its terms prior to the amendments; (c) order Congoleum and the Plan to reimburse participants for benefits which had been denied due to the amendments; and (d) award reasonable costs and attorneys' fees. Retiree medical coverage under the Retiree Medical Program will terminate at such time as there are so salaried retirees participating in the Retiree Medical Program, but in no event later than December 31, 2001.

A class member who elects not to be covered under the Retiree Medical Program with respect to any period of coverage after the effective date of the Stipulation and Agreement, shall be permitted to change such election during the 90-day enrollment period applicable to such period of coverage, but not thereafter. 3. Except as provided in paragraphs 2(a), (b) and (c). benefits provided under the Retiree Medical Program to class members shall be governed by the terms of the Retiree Medical Program. 4.

The cap on the prescription drug component of the Retiree Medical Program will remain at $10.000. 5.
