police officers james fisher cameron leahy and eric mckinley made their first court appearance friday on charges of involuntary manslaughter in the death of mario gonzalez in alameda. they did not enter a plea in a case some say was undercharged for a case like this, a case that not only was all video that it was a murder committed and the charges aren't even murder, it's actually manslaughter. >> that's only a three year minimum. and that's a huge, huge problem. >> the three men were working as alameda police officers when they restrained gonzalez near park and otis in 2021. an initial autopsy noted that gonzalez was under the influence of meth and was obese. but a second autopsy commissioned by his family says he died of restraint asphyxiation in charging the officers. alameda county da pamela price reversed a decision by her predecessor, who had cleared them of wrongdoing. even so, everyone seemed critical of price on friday. julia fox is an attorney representing fisher, who's seen here and is now a contra costa county sheriff's deputy. she accused the da of baselessly

charging the officers out of desperation because she's facing a recall. >> it is so riddled by greed, crippled by reasonable doubt, that i very much look forward to that reality only being affirmed by a jury. should we get that far? >> attorneys for the officers have blasted price for what they call a political prosecution. >> traditionally, the elected da is acknowledged as the honorable da, and i think that her action, certainly in this case, are anything but. >> gonzalez's mother, edith arenales, and relatives also attended the hearing, as did law enforcement officers edgar sanchez once taught gonzalez in oakland to be in there with a room full of police officers, including the ones who murdered mario. >> it was it was not easy. and so but we always stand tall as people. >> officer leahy, seen here in a department post recognizing him for dui arrests, is on paid leave, as is officer mckinley, seen here reading to children.

now, the city of alameda has agreed to pay more than $11 million to settle lawsuits filed by gonzalez's mother and son. these three officers are not in custody, and they will return to court on october 11th. live in alameda. henry lee ktvu, fox two news. >> all right, henry, thank you. >> governor gavin newsom is sidestepping pamela price's office and reaching his own agreement to speed up prosecutions in alameda county. newsom says national guard attorneys will team up with the california department of justice on certain east bay cases. this reshuffling of state and cal guard prosecutors follows the governor's recent move to quadruple the number of chp officers on patrol in oakland. here's what newsom said a few weeks ago, when he claimed the alameda county da's office did not appear to be interested in a partnership. >> we've been disappointed. the lack of engagement with the da's office and so we're moving forward rather than complaining about it rather than lamenting about it at the time, price said she had not heard from the

governor directly and was disappointed in his decision. >> today, she released a new statement saying in part, quote, we hope the swift agreement reached between the doj and cal guard yields equally swift results, and my office is willing to assist in that effort. in any way possible. >> san francisco police are investigating a crash involving one of their emergency vehicles and a cyclist. the accident happened just before 1130 last night near van ness and golden gate avenue. police did not release details about the crash, but say that cyclist sustained non-life threatening injuries and was taken to the hospital. anyone who may have witnessed the crash is asked to call. san francisco police also in san francisco, some alarming video of a man chasing another man with a gun. >> this video here was posted to instagram showing a man running down fourth street, right by the marriott hotel in the city, with another man right behind him holding a gun in his right hand. police say they are investigating this incident that happened on wednesday around 4:30 p.m, and it began when the two men got into a fight. then one of the men pulled out a gun. no injuries have been reported.

>> palo alto police have arrested a homeless man suspected in the death of another homeless man. police say 34 year old alvaro javier lopez was arrested thursday morning inside a parking garage and has been booked into the santa clara county main jail. the victim, 60 year old james alan rudolph, was found dead in a downtown parking garage. police say he died of blunt force trauma to the head. investigators are still trying to figure out the motive. >> well, it is official. after more than a century, the international oil giant chevron will move its headquarters from the bay area to houston, texas. ktvu tom vacar joins us live from san ramon tonight, where chevron currently calls home. and, tom, how soon is this move going to happen? >> well, i'll tell you, it's something that's been taking place over a number of years, but chevron ceo says they hope to have the final move completed by the end of this year at it's somewhat disappointing report to investors quarterly earnings wise, chevron's chief executive spent all of eight seconds on a

gaddis and 39 year old giovanni allison are booked at the marin county jail. police say they believe gaddis intentionally set a fire inside of a tent at the encampment at lee gerner park on tuesday and may be responsible for another fire at the encampment the day before that was never reported to authorities. police say the two women were arrested yesterday after they tried to run out the back door of a vacant house near the encampment. they are each facing a number of charges, including outstanding warrants, burglary and resisting arrest. >> a gofundme has been set up for the homeless man and cancer patient who lost his van in a fire. ryan, six, has stage four cancer and is undergoing treatment at the stanford cancer
